An Aug. 31 fatal accident was caused by a reckless driver, according to the Harris County Sheriff's Office. A man was driving a 2009 black BMW 351 south on the West Lake Houston Parkway, in the 19900 block, in the outside lane. Beside the BMW, in the inside lane, was a 2013 White Ford Fusion traveling south.
According to an accident investigator, the driver in the BMW did not maintain his lane and entered the inside lane. The Ford was forced off of the roadway and onto a median, where it struck a tree.
The accident took place at approximately 11:10 a.m and is under investigation by the HCSO. The man driving the Ford was pronounced dead at the scene.
When someone is killed in a car accident, their family may be left struggling with emotional and financial burdens. If the victim was the breadwinner, the family might lose the person's full-time income and have to pay for funeral and medical expenses.
A skilled personal injury attorney might be able to help the families of accident victims file a wrongful death claim. The driver in this story acted in a reckless manner. In a similar circumstance, the family might choose to file for punitive damages. In situations where someone has behaved in a reckless or careless manner, family members have the option to seek punitive damages in addition to compensation for medical expenses and lost wages. An attorney may research the case and work with the family to determine the amount of compensation to pursue. First, the attorney might negotiate with the insurance company. If the insurance company refuses to pay a fair settlement, the attorney might suggest a civil trial.
